hereinafter referred to as the “Seller”,
and the customer who enters into a sales contract with the Seller through the Only Sharp online store, hereinafter referred to as the “Buyer”.
The online store operates at www.onlysharp.cz.
These Terms and Conditions form an integral part of the sales contract. Any differing provisions agreed directly in the sales contract or order take precedence over these Terms and Conditions.
If the Buyer is a consumer, the relevant provisions of Czech Act No. 89/2012 Coll., the Civil Code, and Czech Act No. 634/1992 Coll., on Consumer Protection, also apply.
- PRODUCT INFORMATION
Information about the goods, their characteristics, prices and availability is provided on the individual product pages in the online store.
Product photographs are primarily for informational purposes. Products made from natural materials, handmade goods or products with individual surface finishes may vary slightly between individual items in colour, grain, texture or other aspects of their appearance.
Such natural variations do not in themselves constitute a defect in the goods, provided that they do not impair their functionality or conflict with the agreed characteristics.
The Seller reserves the right to change the product range, prices and availability. For a particular order, the price and offer applicable at the time the Buyer submits the order are binding.
- ORDERS AND CONCLUSION OF THE SALES CONTRACT
The Buyer places an order using the order form in the online store.
Before submitting the order, the Buyer has the opportunity to check and correct the information entered.
By submitting the order, the Buyer acknowledges that the order entails an obligation to pay for the ordered goods and any associated costs.
After receiving the order, the Seller sends the Buyer a confirmation to the email address provided in the order.
The sales contract is concluded when the Seller confirms acceptance of the order to the Buyer.
The Seller is entitled to refuse or cancel an order, particularly if:
the ordered goods are unavailable,
there is an obvious error in the price or product description,
the Buyer has provided incomplete or clearly incorrect information,
there are reasonable grounds to suspect fraudulent or otherwise unlawful conduct.
If the Buyer has already paid for the order and the sales contract is not concluded or the order is legitimately cancelled, the Seller will refund the amount paid without undue delay.
- PRICES AND PAYMENT TERMS
Product prices are displayed directly in the online store.
Shipping costs or charges for additional services may be added to the price of the goods, depending on the delivery and payment methods selected by the Buyer. These charges are displayed to the Buyer before the order is submitted.
The Buyer may pay for the order using any of the payment methods currently offered in the online store.
The specific payment methods available are always displayed during the ordering process.
The Seller may offer discount codes, promotional prices or other promotional offers. The terms of a particular promotion may separately govern their use.
- SHIPPING AND DELIVERY
Delivery methods, current shipping charges and any conditions for free shipping are provided in the online store and displayed to the Buyer before the order is completed.
The goods will be delivered to the address or pickup point selected by the Buyer in the order.
The Seller will deliver the goods within the agreed period. If no specific period has been agreed, the goods will be delivered without undue delay and no later than the deadline prescribed by law.
If the goods are delivered by a carrier offered by the Seller, the risk of damage to the goods passes to the Buyer upon receipt.
If the Buyer independently selects a carrier that was not offered by the Seller, the risk of damage may pass to the Buyer when the goods are handed over to that carrier, in accordance with applicable law.
The Buyer should check the condition of the parcel upon receipt. We recommend notifying the carrier and the Seller of any visible damage to the packaging without undue delay. This does not affect the Buyer’s statutory rights regarding defective goods.
- WITHDRAWAL FROM THE CONTRACT BY A CONSUMER
If the Buyer is a consumer and has concluded a sales contract through the online store, they have the right to withdraw from the contract without giving any reason within 14 days of receiving the goods, unless the law provides otherwise.
To meet the deadline, it is sufficient for the Buyer to send their notice of withdrawal to the Seller no later than the last day of that period.
The notice of withdrawal may be sent, for example, by email to:
info@onlysharp.cz
or in writing to the following correspondence address:
Sharp Industry s.r.o.
U Pernštejnských 1379/8
140 00 Praha 4
The Buyer may also use the withdrawal form available at https://www.onlysharp.cz/pages/vraceni-zbozi. After submitting the form, they will receive an automatic confirmation by email. The Seller will email them a return shipping label within 24 hours of submission of the form.
The Buyer must return the goods to the Seller no later than 14 days after withdrawing from the contract.
The Seller covers the cost of return shipping, and returns are free of charge for the Buyer unless otherwise agreed. To use the free return service, the Buyer must use the shipping label provided by the Seller.
The Seller will refund the payments received from the Buyer, including the original delivery costs up to the cost of the least expensive delivery method offered, no later than 14 days after withdrawal from the contract.
The Seller is not required to issue the refund before receiving the returned goods or before the Buyer provides proof that the goods have been sent back, whichever occurs first.
The refund will be made using the same payment method used for the original payment, unless otherwise agreed with the Buyer.
The Buyer is liable only for any reduction in the value of the goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functionality.
The right to withdraw from the contract does not apply in cases prescribed by law, for example to goods made to the Buyer’s specifications or personalised to meet their individual needs.
- RIGHTS REGARDING DEFECTIVE GOODS AND COMPLAINTS
The Seller is responsible for ensuring that, upon receipt, the goods are free from defects and have the agreed characteristics and those required by law.
A consumer may exercise their rights in respect of a defect that existed upon receipt of the goods and became apparent within two years of receipt.
Rights regarding defective goods do not apply, in particular, to:
normal wear and tear caused by ordinary use,
damage caused by improper use,
damage caused by unsuitable maintenance or storage,
mechanical damage occurring after receipt of the goods,
characteristics or changes consistent with the nature of the material used and normal wear and tear.
For kitchen knives, normal, gradual dulling of the cutting edge through use is not considered a defect.
For carbon steel products, the natural formation of a patina or a change in surface colour resulting from ordinary use and contact with food does not, in itself, constitute a defect.
This does not affect the Buyer’s rights in the event of an actual defect in materials or workmanship.
A complaint may be submitted, in particular, by email to:
info@onlysharp.cz
or by sending or delivering the goods to the Seller’s correspondence address:
Sharp Industry s.r.o.
U Pernštejnských 1379/8
140 00 Praha 4
When submitting a complaint, we recommend providing the order number, a description of the defect and the preferred remedy.
The Seller will provide the consumer with confirmation that the complaint has been submitted and subsequently with confirmation of how and when it was resolved.
A consumer’s complaint will be resolved without undue delay, no later than 30 days after its submission, unless the Seller and the consumer expressly agree to a longer period.
The Buyer’s specific rights regarding defective goods are governed by applicable law, particularly the Czech Civil Code.
- USE AND CARE OF GOODS
The Buyer must use the goods in a manner appropriate to their nature and in accordance with the instructions provided on the product page or supplied with the goods.
For kitchen knives, it is particularly important to follow the recommended instructions for use, sharpening, cleaning and storage.
Unless otherwise stated for a particular product, we recommend that kitchen knives:
are not washed in a dishwasher,
are washed by hand after use and dried immediately,
are not used to cut bones, frozen foods or other hard materials unless expressly intended for that purpose,
are used on a suitable cutting surface,
are stored safely to prevent damage to the cutting edge.
Failure to follow the recommended instructions for use and care may result in damage that does not necessarily constitute a defect for which the Seller is liable.
- USER ACCOUNT
If the online store allows customers to create an account, the Buyer is responsible for the accuracy of the information provided during registration.
The Buyer must protect their login credentials and must not disclose them to third parties.
The Seller may delete a user account, particularly if it has not been used for an extended period or if these Terms and Conditions or applicable laws have been breached.
- PERSONAL DATA PROTECTION
Information about how the Seller processes customers’ personal data is provided in the separate Privacy Policy published in the online store.
The online store uses the Shopify platform and other providers of technical, payment, analytics, marketing and shipping services. To the extent necessary, these providers may process customers’ personal data under the conditions laid down by applicable law and the relevant privacy policies.
- COPYRIGHT AND INTELLECTUAL PROPERTY
The content of the online store, particularly texts, photographs, graphic elements, logos, videos and other materials, is protected by applicable law.
Without the prior consent of the Seller or the relevant rights holder, unauthorised copying, modification, distribution or use of this content for commercial purposes is prohibited.
This does not affect users’ statutory rights.
- REVIEWS AND USER CONTENT
If the Buyer publishes a review or other user content through the online store, they are responsible for ensuring that the content is not unlawful and does not infringe the rights of third parties.
The Buyer grants the Seller permission to use the published review or similar content in connection with the presentation of products and the online store, to an extent consistent with the purpose for which the content was provided.
The Seller is entitled to remove content that is unlawful, unrelated to the product being reviewed, contains spam or otherwise seriously violates the rules of the online store.
- TECHNICAL ERRORS AND AVAILABILITY OF THE ONLINE STORE
The Seller endeavours to ensure that the information provided in the online store is accurate and up to date.
If an obvious technical error occurs, such as a clearly incorrect price or product availability indication, the Seller will inform the Buyer and propose how to proceed.
The Seller does not guarantee uninterrupted availability of the online store, particularly due to maintenance, technical problems or circumstances beyond their control.
- OUT-OF-COURT RESOLUTION OF CONSUMER DISPUTES
If a consumer dispute arising from a sales contract occurs between the Seller and a consumer and cannot be resolved by mutual agreement, the consumer may submit an application for out-of-court resolution of the dispute.
The competent body is:
Česká obchodní inspekce (Czech Trade Inspection Authority)
Ústřední inspektorát – oddělení ADR
Gorazdova 1969/24
120 00 Praha 2
Information about out-of-court dispute resolution is available on the website of the Czech Trade Inspection Authority.
- BUSINESS BUYERS
If the Buyer enters into a sales contract in the course of their business or self-employed professional activities, they are not considered a consumer.
The provisions of these Terms and Conditions and applicable laws that provide special protection to consumers apply to such a Buyer only where required by law or expressly agreed by the parties.
- GOVERNING LAW
The legal relations between the Seller and the Buyer are governed by the laws of the Czech Republic.
If the Buyer is a consumer residing in another Member State of the European Union, this does not affect the rights granted to them by the mandatory laws of the country of their habitual residence, insofar as those laws apply to the relationship.
- FINAL PROVISIONS
If any provision of these Terms and Conditions becomes invalid or ineffective, this does not affect the validity of the remaining provisions.
The Seller may amend or supplement these Terms and Conditions to a reasonable extent. For a particular sales contract, the version of the Terms and Conditions in effect when the contract is concluded is binding.
These Terms and Conditions are available to the Buyer before the order is finalised and may be archived and reproduced.
